1. About these terms

These terms are an agreement between you and Bealach Nua OÜ ("we", "us"), the maker of Nutrition Cognition. They cover the iPhone app, the Apple Watch app and widgets, the web app, and the connector that lets AI apps such as Claude and ChatGPT use your account. By using Nutrition Cognition you agree to them. Our privacy policy explains how we handle your data.

2. Your account

• You need to be at least 13. If you're under the age at which you can agree to these terms yourself where you live, a parent or guardian needs to agree for you.
• Give accurate details, keep your sign-in to yourself, and tell us if you think someone else has used your account.
• One account is for one person.

3. Using Nutrition Cognition

Use it for your own food log and goals, lawfully and fairly. Don't:

• try to get into other people's accounts or data, or get round our security or limits;
• overload, disrupt or reverse-engineer our services, or collect data from them by automated means, except through an AI app you've connected as intended;
• upload anything unlawful, harmful, or that you don't have the right to share.

We limit how often our services can be called, to keep them working for everyone.

4. Not medical advice

Nutrition Cognition helps you keep track of what you eat. It isn't medical, dietary or health advice, and it doesn't diagnose or treat anything. Nutrition values can be wrong: they come from us, from Open Food Facts, from you and from your friends. Goals from official guidelines are general, not tailored advice. AI apps you connect can make mistakes too. Talk to a doctor or dietitian before making big changes to how you eat, especially if you have a medical condition, are pregnant, or have had an eating disorder.

5. Pro and the free trial

• Some features come with Pro. When you finish setting up, you get a free month of Pro, once per account.
• You buy Pro in the iPhone app, from Apple. Apple charges you and renews your subscription under its terms until you cancel it in your Apple account's settings, at least a day before it renews. Refunds are handled by Apple.
• We may change what comes with Pro, or its price; a new price applies from your next renewal after Apple tells you.

6. Your content

What you log and save is yours. You let us store, process and show it as needed to run Nutrition Cognition for you, including to the friends you share it with and the AI apps you connect. Food data from Open Food Facts is available under the Open Database License. The rest of Nutrition Cognition (its software, design and our curated foods) is ours.

7. Claude, ChatGPT and other services

When you connect an AI app, you let it read and change your account as described in our privacy policy. The AI app is provided by another company under its own terms. We're not responsible for what it says or does, including what it logs or changes on your behalf, so check its work. You can disconnect it at any time. Other services we work with, such as Apple Health and Sign in with Apple or Google, are also governed by their own terms.

8. Apple

If you use the iPhone or Watch app: these terms are between you and us, not Apple. Apple isn't responsible for the app or its content, and has no obligation to support it. If the app fails to meet a warranty that applies, you can tell Apple, which may refund its price; Apple has no other warranty obligation. Apple isn't responsible for any claims about the app, including product liability, legal compliance or intellectual property; we are, as far as these terms say. You must follow the App Store's terms, and Apple and its subsidiaries can enforce these terms as a third party.

9. Ending your account

You can stop using Nutrition Cognition at any time, and ask us to delete your account (see the privacy policy). Cancel Pro in your Apple account first; deleting your account doesn't cancel it. We may suspend or close an account that breaks these terms, and we'll tell you why unless the law or safety stops us.

10. Disclaimers and liability

We work hard to keep Nutrition Cognition accurate and available, but we provide it as it is, without promising it will always work or be error-free. As far as the law allows, we aren't liable for indirect or unforeseeable loss, or for loss caused by AI apps or other services you use with it. Nothing in these terms limits liability that can't be limited by law, or your rights as a consumer.

11. Changes to these terms

We may update these terms. We'll change the date above, and tell you in the app or by email before a change that matters takes effect. If you keep using Nutrition Cognition after that, the new terms apply.

12. Governing law

These terms are governed by the laws of Estonia. If you're a consumer, you also keep the protection of the mandatory laws of the country you live in, and you can bring a claim there.
